What Is Proposition 65?

Questions and Answers about California’s Prop 65 Law

Q: Why does my product say “WARNING: This product contains lead, a chemical known to the State of California to cause birth defects or other reproductive harm”?
A: This statement is legal text required by the state of California (it is not required by any other state in the U.S.).

Q: What is Proposition 65?
A: California has a law called Proposition 65 that requires businesses to provide a warning if their products include any of over 900 different man-made and naturally occurring chemicals and other substances. For example, aspirin and aloe vera leaf extract are both on the list.

Q: Why do your competitor’s products not include this warning?
A: If their products include any of the substances on the Proposition 65 list and if their products are sold in California, they are legally required to include the warning. If they fall into that category and don’t include the Proposition 65 warning, they are violating the law.

Q: Do products with the Proposition 65 label cause harm?
A: All of our products are tested for safety. Proposition 65 warnings are required when the amount of a chemical in a daily exposure is anything more than what the state of California considers a “Safe Harbor” number (some allow as little as 1/1000th of the amount that scientific studies have documented shows no observable effect on health).
